Terms of Service

These Terms of Service (the “Terms”) govern your use of the Android app “my Diary” (the “App”) provided by Hinata Studio (“we”, “us”). By using the App you agree to these Terms.

1. Scope

These Terms apply to all matters between you and us relating to the App.

2. Account

• Using the App requires an account with an email address and password.
• You may not use the App if you are under 13. If you are 13 or older but under 18 — or under the higher age set by the law of your country — please use the App with the permission and supervision of your parent or guardian.
• You are responsible for keeping your account details and password secure.
• You can delete your account at any time from Settings (⚙) → “Delete account”. Deletion is immediate, permanent and cannot be undone.

3. Free plan and Premium plan (subscription)

• The App has a Free plan and a Premium plan. The Free plan costs nothing and gives you the core diary and recipe features. Some features — a higher photo limit, sharing with friends, and full access to decorations — are offered as the paid Premium plan (subscription).
• The subscription is sold and processed through Google Play. Pricing, billing, renewal and cancellation follow Google Play’s subscription system. We never receive your payment card details.
• The price, currency and billing period that apply are those shown in the Google Play Store at the time of purchase. Prices vary by country and region.
• Subscriptions renew automatically and are charged on each renewal date unless cancelled.
• If you are a minor, get your parent's or guardian's consent before subscribing to the Premium plan. Because payment goes through Google Play, a parent or guardian can control purchases using Google Play's purchase authentication and family settings.
• You can cancel in the Google Play Store → (your profile) → Payments & subscriptions → Subscriptions. After cancelling you keep the Premium plan until the end of the current billing period.
• We do not offer pro-rata refunds. Refunds are handled under Google Play’s refund policy. Where the law of your country grants you a right of withdrawal or similar, this clause does not limit that right.
• Sharing entries with a friend requires both of you to have the Premium plan. If only one of you subscribes, the feature cannot be used.
  After cancelling you return to the Free plan. Nothing you have already saved is deleted, but you can only add new photos up to the Free plan limit (20 photos), and sharing with friends stops being available. Decorations you have collected remain usable, but note skins and illustrations that were available to you only through the Premium plan stop being available, and the pages you put them on are shown without the decoration (the setting itself is kept, so collecting the same items or subscribing again brings them back).
  At that point your friend connections (added by QR code) and any “share with friends” settings are removed — you disappear from each other’s lists. Your diaries, recipes and photos themselves are not deleted. To become friends again, scan the QR code once more.
• Deleting your account does not cancel your subscription. Cancel in the Google Play Store to stop being billed.

Please note: the App does not provide a way to export your entries or photos in bulk. Once you delete your account, your entries and photos cannot be recovered. If there is anything you want to keep, please save it elsewhere before deleting.

Please note: the App is not a photo storage service. Photos you attach are compressed automatically to a size suitable for viewing in the App, and the original file is not stored (see the Privacy Policy). Please keep the original of any photo that matters to you on your own device or backup.

4. Your content

• You retain all rights to the diaries, recipes and photos you create in the App.
• We handle your content only as far as needed to run the service (storing, displaying and processing it on the backend). We never sell or publish your content.
• If you mark an entry as shared with friends, the people you have mutually approved can view it (read-only). Entries are private by default. Removing a friend works both ways — you can no longer read their entries either.
• Personal information is handled as described in our Privacy Policy.
• We are under no obligation to monitor your content. However, where we consider content (including photos) to break the law or to be against public order and morals, we may hide or delete that content, or stop it being shared with friends. Except where the matter is urgent, we will tell you at your registered email address beforehand or promptly afterwards. Your diaries and recipes matter to you, so we keep any such action to the minimum necessary.

5. Prohibited conduct

You must not:

• break the law or act against public order and morals;
• infringe the rights of others (intellectual property, privacy and so on);
• disclose or republish another user’s entries obtained through the friend feature without their consent;
• place an excessive load on our servers or network, gain unauthorised access, or reverse engineer the App;
• do anything else we reasonably consider inappropriate.

If you break these rules, we may — in addition to the steps set out in section 4 — suspend or delete your account.

We may also disclose information where we receive a lawful request under the law, such as a court warrant or a request from a law enforcement authority. See “Who we share information with” in our Privacy Policy for details.

6. Changes, suspension and discontinuation

We may change, suspend or discontinue the App. If we discontinue the service we will give notice in the App or on this page beforehand, except where that is not reasonably possible. Our liability for any resulting loss is as set out in section 7.

7. Disclaimer

• The App is provided “as is”. We do not warrant that it will operate without faults or that data will always be preserved. Please keep your own copies of anything important to you.
• Except in cases of our intent or gross negligence, we are not liable for loss arising from your use of the App.
• Nothing in this section limits any right you have as a consumer under the mandatory law of your country. We remain liable where liability cannot be excluded by law.

8. Changes to these Terms

We may update these Terms. Significant changes will be announced on this page. Continuing to use the App after a change means you accept the updated Terms.

9. Governing law and jurisdiction

These Terms are governed by the laws of Japan, and the court with jurisdiction over our location shall be the court of first instance. If, as a consumer, the law of your country gives you the right to bring proceedings in your local courts, this clause does not remove that right.

本利用規約（以下「本規約」）は、Hinata Studio（以下「当方」）が提供する Android アプリ「my Diary」（以下「本アプリ」）の利用条件を定めるものです。利用者（以下「ユーザー」）は、本アプリを利用することにより、本規約に同意したものとみなされます。

第1条（適用）

本規約は、本アプリの利用に関する当方とユーザーとの間の一切の関係に適用されます。

第2条（アカウント）

• 本アプリの利用にあたっては、メールアドレスとパスワードによるアカウント登録が必要です。
• 13歳未満の方は、本アプリをご利用いただけません。13歳以上18歳未満の方（お住まいの国の法令でより高い年齢が定められている場合は、その年齢未満の方）は、保護者の方の許可を得たうえで、保護者の方の監督のもとでご利用ください。
• ユーザーは、登録情報およびパスワードを自己の責任で適切に管理するものとします。
• アカウントは、アプリ内の 設定（⚙）→「アカウント削除」 からいつでも削除できます。削除は即時かつ恒久的で、取り消しできません。

第3条（プレミアムプラン／定期購入）

• 本アプリにはフリープランとプレミアムプランがあります。フリープランは料金がかからず、日記・レシピの基本機能をご利用いただけます。写真の保存枚数の解放、友達とのデータ共有、装飾の全解放などの一部機能は、有料のプレミアムプラン（定期購入）として提供されます。
• 販売・決済は Google Play を通じて行われます。料金・課金・更新・解約は Google Play の定期購入の仕組みに従います。当方がクレジットカード情報等の決済情報を受け取ることはありません。
• 価格・通貨・請求期間は、購入時に Google Play ストアの画面に表示されるものが適用されます。国・地域により価格は異なります。
• 定期購入は、解約されない限り各更新日に自動的に更新され、課金されます。
• 未成年の方がプレミアムプランを申し込む場合は、保護者の方の同意を得てください。お支払いは Google Play を通じて行われるため、保護者の方は Google Play の「購入時の認証」やファミリー向けの設定により、購入を管理いただけます。
• 解約は Google Play ストア →（プロフィール）→「お支払いと定期購入」→「定期購入」から行えます。解約しても、当該請求期間の終了まではプレミアムプランの機能を利用できます。
• 当方からの日割りによる返金は行いません。返金の可否および手続は Google Play の返金ポリシーに従います。お住まいの国・地域の法令によりクーリングオフ等の権利が認められている場合、その権利は本項によって制限されません。
• お友達とのデータ共有は、おたがいにプレミアムプランのご登録が必要です。片方だけのご登録では、この機能はご利用いただけません。
  解約後はフリープランの内容に戻ります。すでに保存された記録・写真が削除されることはありませんが、写真の新規追加はフリープランの上限（写真 20 枚）まで、友達とのデータ共有はご利用いただけなくなります。集めた装飾は引き続きお使いいただけますが、プレミアムプランだから使えていた着せ替え・挿絵は使えなくなり、それらを付けたページは飾りのない状態で表示されます（設定そのものは消えないので、同じ飾りを集めるか、もう一度ご登録いただくと元に戻ります）。
  このとき、QRコードで登録したお友達との繋がりと、「友達に公開」の設定は解除されます（おたがいの一覧から消えます）。日記・レシピ・写真そのものは消えません。もう一度お友達になるには、QRコードを読み取り直してください。
• アカウントを削除しても、定期購入は自動では解約されません。請求を止めるには、Google Play ストアで解約してください。

※本アプリには、記録や写真を一括で書き出す（エクスポートする）機能はありません。アカウントを削除すると、記録・写真は復元できません。残しておきたいものがある場合は、削除の前に画面の内容を控えるなどしてください。

※本アプリは、写真の保管（ストレージ）を目的とするサービスではありません。添付された写真は、アプリ内で見るのに適したサイズに自動で圧縮して保存され、撮影したままの原本は保存されません（詳細は プライバシーポリシー）。大切な写真は、必ずご自身の端末やバックアップに原本を保管してください。

第4条（ユーザーのコンテンツ）

• ユーザーが本アプリに記録した日記・レシピ・写真等のコンテンツの権利は、ユーザーに帰属します。
• 当方は、サービスの提供（保存・表示・バックエンドでの処理）に必要な範囲でのみ、これらのコンテンツを取り扱います。当方がユーザーのコンテンツを第三者へ販売・公開することはありません。
• ユーザーが記録の公開範囲を「友達に公開」に設定した場合、相互に承認した友達がその記録を閲覧のみできます。公開範囲の既定は「自分のみ」です。友達関係の解除はおたがいに効きます（相手の記録も読めなくなります）。
• 個人情報の取扱いは プライバシーポリシー に定めるとおりです。
• 当方は、ユーザーのコンテンツを常時監視する義務を負いません。ただし、法令または公序良俗に反すると当方が判断したコンテンツ（写真を含みます）については、当該コンテンツの非表示・削除、または友達への公開の停止を行うことがあります。緊急を要する場合を除き、あらかじめ、または事後すみやかに、ご登録のメールアドレス宛にその旨をお知らせします。日記・レシピはユーザーにとって大切な記録であるため、当方はこの措置を必要最小限の範囲で行います。

第5条（禁止事項）

ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。

• 法令または公序良俗に違反する行為
• 他者の権利（知的財産権・プライバシー等）を侵害する行為
• 友達機能を通じて知り得た他のユーザーの記録を、本人の同意なく第三者に開示・転載する行為
• 本アプリのサーバーやネットワークに過度な負荷をかける行為、不正アクセスやリバースエンジニアリング等の行為
• その他、当方が不適切と判断する行為

ユーザーがこれらに違反した場合、当方は、第4条に定めるコンテンツの措置に加え、アカウントの利用停止または削除を行うことがあります。

また、裁判所の令状や捜査機関からの適法な照会など、法令に基づく求めがあった場合、当方はこれに応じて情報を提供することがあります。詳しくは プライバシーポリシー「情報の提供先」をご覧ください。

第6条（サービスの変更・中断・終了）

当方は、本アプリの内容の変更、提供の一時中断または終了を行うことがあります。サービスを終了する場合は、やむを得ない場合を除き、事前に本アプリ内またはこのページで告知します。これによりユーザーに生じた損害について、当方は本規約第7条の範囲で責任を負います。

第7条（免責事項）

• 本アプリは現状有姿で提供され、当方は、本アプリが不具合なく動作すること、データが常に保全されることを保証しません。重要なデータはユーザー自身でも適切に管理してください。
• 当方は、本アプリの利用によりユーザーに生じた損害について、当方の故意または重過失による場合を除き、責任を負いません。
• 本条は、消費者としてのユーザーに対し、お住まいの国・地域の強行法規により認められる権利を制限するものではありません。法令上排除できない責任については、本条にかかわらず当方が負います。

第8条（本規約の変更）

当方は、必要に応じて本規約を変更することがあります。重要な変更がある場合は、本ページ上で告知します。変更後に本アプリを継続して利用した場合、変更後の規約に同意したものとみなされます。

第9条（準拠法・管轄）

本規約は日本法に準拠します。本アプリに関して紛争が生じた場合は、当方の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。ただし、消費者としてのユーザーが、お住まいの国・地域の法令により自国の裁判所に提訴する権利を有する場合、本項はその権利を妨げません。
